Research Abstract |
Using Friedrich Carl von Savigny’s own manuscripts of his System of the Modern Roman Law (Systemdes heutigen Romischen Rechts, 1840), I considered the following three problems. First, the process bywhich the “plan” of System was formed; second, Savigny’s drafting of the “Preface” of System; and third,the process by which he formed his ideas regarding the jurisprudence of the sources of law(Rechtsquellenlehre) described in System. From this study, I was able to glean insight regarding thecharacteristics of the manuscripts and the period during which they were composed, as well as cluestowards elucidating the process by which System came to be formed.
