NAGPRA entails that agent under NAGPRA be a “modern” construct of ethnicity in the Article on “Cultural Affiliation.” The ethnicity, as defined by that Article, tends to be exclusive, as seen in the famous controversy in the American Southwest, and thus, it appears that the concept was not able to resolve the controversy. To that extent, it needs some modification. In addition, this study focuses on non-religious items in art market, in which Indigenous People can determine interpretation on their items. Art market can be regarded as a fruitful opportunity for them, allowing them to expose their work of art to contingency. An application of NAGPRA to Japanese context has to be careful, as Freedom of Religion has not been seriously discussed by stakeholders and museums.
