Research Abstract

I confirmed that distinction between content-based and content-neutral regulations is founded not only on principle, but also on institutional factors by re-examining its doctrinal basis. If the institutional factors are important, we can mitigate rigidity of the distinction through their empirical analysis. Based on this analysis, our Court should not think the distinction too rigid, and conduct appropriate scrutiny for content-neutral regulations.
