| Outline of Research at the Start |
家事事件実務の実態の解明を，研究協力者としての実務家に研究会に参加してもらい、実務の実態の報告をしてもらったうえで、研究者が当該実態を分析し、あるべき実体法理を提示し、それに対して、実務家も含めた研究メンバーが批判的検討を行うという形で研究を進めていく。つまり、「実務と理論の対話」を通じて、あるべき実体法理の構築を目指す。
具体的には，例えば、離婚が増加し、離婚後の親子の交流についての紛争が増加・激化する中で、その紛争の実態、解決すべき課題を明らかにするとともに、その紛争解決のためにあるべき理念を示す。

| Outline of Final Research Achievements |
This research project aimed to clarify the actual state of family law practice by having researchers and practitioners present reports on the same theme at study meetings.Specifically, seminars are held annually on themes such as child custody and child abuse, inheritance division, and post-divorce child rearing, with the outcomes published in journals, including‘Theory, Practice, and Case Law of Family Law.’ Additionally, each research team member conducts research on issues related to family law cases, taking into account practical considerations and recent legal reforms, and publishes their findings in academic papers.

| Academic Significance and Societal Importance of the Research Achievements |
『家事法の理論・実務・判例』や法律時報96巻11月号に掲載した。児童虐待、遺産分割といった伝統的に議論はされてきたが理論的な検討が必ずしも十分でない問題について、実務の問題点を踏まえて理論的な分析を行った。また、離婚後の子の養育などについての改正を行った令和6年民法改正を踏まえて、離婚後の親権者の決定など、新たに生じた問題について深い検討を行った。
