| Outline of Research at the Start |
各省設置法は中央省庁にとって最も重要な行動基準であり、その形式や内容は戦後日本の行政に大きな影響を与え続けてきた。占領期における各省設置法の立案過程には、各省設置法に上位する内閣法や国家行政組織法の立案過程を主導したGHQの民政局のみならず他の局も積極的・継続的に関与した。にもかかわらず、先行研究では、民政局以外の各局の関与の実態や当該関与がもたらした影響が明らかにされてきたとは言いがたい。
そこで本研究の目的は、GHQの各局による各省設置法の立案過程への関与が同法の形式・内容にもたらした影響を解明するところにある。

| Outline of Final Research Achievements |
This study first analyzed the political process and actual provisions of the enactment of the Law for the Establishment of the Ministry of Telecommunications, the successor to the Law for the Establishment of the Ministry of Posts and Telecommunications, which was the “model” law for the establishment of ministries enacted during the occupation. As a result, it was revealed that the law had innovative provisions at the time, such as organizational structure based on line organization.
We compared then the political process of enacting the law establishing the Ministry of Telecommunications with the political processes of enacting the laws establishing other ministries. As a result, we found that the presence or absence of inter-ministerial conflicts over the affairs under their jurisdiction and the presence or absence of cross-national coalition formation affected the organizational size of the other ministries.

| Academic Significance and Societal Importance of the Research Achievements |
本研究の一つ目の学術的意義は、占領期に制定された電気通信省設置法がライン・オーガニゼーションという当時としては革新的な組織編成原理を採用しており、各省設置法は戦前の各省官制をそのまま法律化したに過ぎないとする通説的見解に反証を示したことにある。
本研究のもう一つの学術的意義は、各省設置法が定める組織規模の違いとその要因を明らかにしたことにある。電気通信省と同じ事業系の官庁である建設省、農林省及び運輸省の各省の組織規模を左右したのは、各省設置法制定過程における所掌事務を巡る省間コンフリクトと日米のクロス・ナショナルな連合形成の有無である。
