幇助犯の中心的な成立要件である因果関係についてはなお不明瞭なところが多く、それは人の心理を介する心理的幇助犯において特に顕著であるが、近時では心理的な働きかけの程度が大きいとは言い難い事案で幇助犯の成立を肯定した最高裁判例が現れるなど、判断基準の明確化は喫緊の課題である。本研究は、心理的幇助犯における因果関係について、人の心理を介するという特殊性が判断枠組みに与える影響を明らかにするとともに、具体的な判断基準の定立を試みる。

| Outline of Final Research Achievements |
In this study, I presented specific criteria for determining causality in psychological aiding on the basis of its unique characteristics. Conventional theories have pointed out that the causal relationship of psychological aiding involves special problems not found in physical aiding, and the criteria for determining it have not been clarified. The conclusions of this study are as follows: (1) The often-pointed characteristics of causality in psychological aiding do not create a difference in the content of the causal relationship between physical aiding and psychological aiding. (2) Based on the position that causality to the outcome is unnecessary for physical aiding, it is possible to obtain common and specific criteria for determining causality in both.

| Academic Significance and Societal Importance of the Research Achievements |
以上の研究成果は、判例上判断基準が明確とは言い難く、学説上も明確な判断基準が与えられていなかった心理的幇助犯における因果関係の問題について、理論的な一貫性と明確性を備えた判断基準を提示するものであり、幇助犯の因果関係を巡る議論の精緻化に貢献するとともに、裁判実務に一定の示唆を与え得る点で社会的意義も有している。また、日本の学説において惹起説・因果的共犯論が定着していることを踏まえると、以上の研究成果は、正犯者の心理を介した共犯現象一般に共通する理論的基盤を提供するものであり、共謀共同正犯や教唆犯を巡る各種の議論の発展にも資するものといえる。
