Research Abstract |
"Therapeutic Jurisprudence" is a new concept that court proceeding is considered as a kind of tool providing the defendants problem solving way for their rehabilitation in stead of traditional concept, so called adversary system, which has been thought the proceeding as legal battle between prosecutor and defendant. In this research project, two concepts were analyzed and the difference was defined for renovating the Japanese criminal justice by implementing therapeutic ideas.
