本研究は、アメリカ憲法の下での最新の宗教的自由の保障内容を明らかにすべく、合衆国最高裁判所における信教の自由および政教分離原則に関する最近の判例展開を分析するものである。かくして、本研究は、かつてのレーンキスト・コートに至るまでの信教の自由および政教分離原則に関する判例法理との比較から、現在進行形のロバーツ・コートの下での信教の自由および政教分離原則に関する諸判決を考察していく。
