Outline of Research at the Start

古来、養子縁組は家や財産の継承者となる者を求める「親のための養子制度」であったが、近代では、親のいない子に親を与える「子のための養子」が制度理念となった。ドイツは1970年代に子と実親との法律関係を終了させる完全養子に転換し、日本も1988年に特別養子を制度化した。2010年代になり、実親との交流を可能とする養子縁組、匿名出産・内密出産で生まれた子の養子縁組、同性婚カップルによる養子縁組など、養子縁組のニーズが変容している。養子縁組をめぐる需要の変化とそれに対する「子のための養子法」の理念の対抗関係を主にドイツを比較対象として比較法的に分析する。
