Outline of Research at the Start

本研究は、国際仲裁におけるdue process paranoia（適正手続パラノイア）論を素材として、仲裁における手続保障のあり方を検討するものである。当事者の仲裁合意を基礎とする仲裁は、訴訟と異なる手続構造を有する一方、仲裁判断は確定判決と同一の効力を有する。しかしその前提として、仲裁に訴訟と同様の手続保障が要求されるか否かは明らかではない。実務では適正手続パラノイアにより仲裁廷が手続裁量権の行使を躊躇する結果、審理の長期化・費用の高騰化が生じ、当事者の不満が生じることが指摘されている。本研究では、この問題を解決すべく、先行研究や判例の分析から仲裁における手続保障のあり方について検討する。
