Outline of Research at the Start	本研究の目的は、スペインの後期スコラ学派がグロチウスを経由して近世自然法論、さらには近代私法にきわめて重要な影響を及ぼしたことを明らかにすることにある。具体的には、グロチウスが自身の『オランダ法学入門』において、後期スコラ学派の原状回復（restitutio）論を継承しつつ、絶対的所有権概念を基礎とする私法体系のなかで、債務の発生原因として「約束（toezegging）」と「不均衡（onevenheid）」（不当利得および不法行為）を挙げ、近代法典にも採用される契約およびその他の発生原因という分類を基礎づけたことを解明する。
