Outline of Research at the Start

刑法上の犯罪の成立には、多くの場合、犯罪を構成する客観的事実を認識しつつ敢えて行為に出たという意味での故意が要求される。本研究はこの故意の認識的部分について、客観的事実の認識に加えて「意味の認識」までがさらに必要であるとする学説の主潮流を端緒として、学説上の議論と個別の犯罪について現に要求される認識内容とを丹念に結びつけ、その全体像を明らかにしようとするものである。
