民主的正統性を背景に統治の中心を担う政治部門とは対照的に、専門知識に基づき長期的な公益を確保する任務を帯びる独立機関は、民主政における「異物」のようにも見えるが、統治を成立させるには、独立機関が機能を発揮することが不可欠である。
本研究では、主に憲法学の観点から、法の定立・執行はもとより、政策の形成を含めた広い意味での統治プロセスを形作る「構造」に着目し、そこにおける「独立機関」の役割・意義のほか、そのような「独立機関」が必要となる条件や独立性の保障をはじめとする独立機関が機能する諸前提を提示しようとするものである。

| Outline of Final Research Achievements |
This study examines a variety of “independent bodies” such as courts, independent administrative commissions, central banks, public broadcasters, and universities, analyzing their significance and functional conditions within the structure of governance from a constitutional perspective. The research findings are classified into three areas: (1) consistency with the principles of democracy, (2) challenges in securing actual independence, and (3) examination of the autonomy of experts. Each area addresses issues such as the constitutional justification of central banks, reforms in the judicial system, and challenges surrounding university autonomy.

| Academic Significance and Societal Importance of the Research Achievements |
民主政国家においては、あらゆる政治的意思決定は民意に基づいて行われるようにも思われるが、実際には民意とは距離をおいた国家機関や公的な組織も重要な役割を果たしている。国家機関やそれに準じるものとしては裁判所や中央銀行などがあり、その他にも大学や学会など専門家の団体などもある。
本研究では、これらの独立機関が民主主義において果たしている（果たすべき）役割はなにか、あるいは、独立性を確保しつつその役割を果たすために必要な仕組はどのようなものかということを、多くの独立機関の事例を通じて考察したものである。
