| Outline of Research at the Start |
日本の労働適齢人口の急減に伴い、移住労働者とその家族の受入れと人権問題は喫緊の課題であり、出入国及び在留管理制度は大きな再編成の時期を迎えている。日本では長らく移民受入れ政策を採用せず、既存の在留資格の若干の変更と運用で対応してきたため、この分野の国際条約の締結や総合的国内法制の整備はまだ不十分な点が少なくない。本研究では、コロナ禍以降の外国人労働力受け入れを含めて、人の国際移動に伴う国際法国内法上の問題を移住労働の現状と実態分析を踏まえて分析し、必要な国際基準の実施と国内法制の改正動向も踏まえて、移住労働者とその家族の権利保護に関する課題と方向性を書籍の形で提案することをめざしている。

| Outline of Final Research Achievements |
Throughout the three years of joint and individual research works concerning the topic mentioned above, members of our team have published 60 articles and 11 books and made 18 speeches in academic meetings touching upon certain aspects of the topic. These outcome papers analyze and clarify the background of historical change of Japan's policy regarding transnational migrant workers to address the shortness of labour resources in Japan as well as contents, progress, remaining problems and challenges of national laws and regulations concerning immigration control and refugee recognition in the light of international protection of human rights of transnational migrants defined in international instruments such as International Convention on the Protection of Rights of All Migrant Workers and Members of Their Families. Our team is now preparing for the book consisted of new articles dealing with various aspects of the topic of our reseach.

| Academic Significance and Societal Importance of the Research Achievements |
人口の高齢化と若い労働力不足に対処するため日本政府は特定技能や育成就労の在留資格で外国人労働者の受入れを促進している。また不安定な国際情勢の下日本に難民認定申請する外国人の数も増えている。日本に在留する外国人の増加が予測される中、共生社会の実現にとって国連移住労働者権利条約をはじめとする国際規範が非正規在留者を含めて外国人の人権保護について何を求めているか、国内法制度の再編は国際基準にどう対処しようとしているのかを検討し、理論的、実務的な課題をいくつかの点で明らかにした点に意義がある。
