Outline of Research at the Start

先住民の権利（先住権）は1990年代以降、国際法によって認められてきた。2024年現在、ラテンアメリカで「先住民の土地権」を憲法上で認めた国は15カ国に上る。しかし、現実の制度と運用との間には「乖離」が存在する。「実質的土地権の保障」は、いかなる要因により実現するのか。この問いに対して、本課題では中米７カ国を対象とし、同地域の先住民の本研究への主体的参画を得て、その原因を明らかにする。
