Outline of Research at the Start

これまで別々に行われてきた北極域と南極域に関する国際法研究を、国際共同研究を通して統合し、新たな学問分野としての「極域国際法」の存立基盤を確立する。両極域においては、気候変動の増幅効果が顕著に現れ更なる科学観測や予防原則に基づく慎重な資源開発が求められるにも関わらず、地政学的挑戦を受けて国際協力が停滞している。極域国際協力を再構築するための新たな極域国際法研究を推進するため、フィンランド・ラップランド大学とオーストラリア・タスマニア大学等と共同して、両極域を統合するグローバル学術ネットワークを構築する。

Outline of Annual Research Achievements

本研究は、北極域と南極域に関する国際法研究を、国際共同研究を通して統合し、新たな学問分野としての「極域国際法」の存立基盤を確立することを目的とする。また、国際情勢が流動化する中で多くの挑戦を受けている極域国際協力を再構築するための新たな極域国際法研究を推進するため、フィンランド・ラップランド大学とオーストラリア・タスマニア大学等と共同して、両極域を統合するグローバル学術ネットワークを構築する。

本研究の二年目となる本年度は、若手分担研究者2名を国際ワークショップ、国際学会に派遣し、国際共同研究の企画及び実施を主導し、研究発表をする場を提供した。9月フィンランド・ラップランド大学北極研究センターの場を借りて、日本の北極政策に関するワークショップを企画した。またその直後にスウェーデン・ミッドスウェーデン大学で開催された第１7回極域法国際シンポジウム(PLS)では、本課題に関わるセミナーを企画し研究発表を行った。加えて、本課題の目標とするPLSを活用した国際共同研究の更なる進展をサポートするための諸活動、具体的には同シンポの年鑑Yearbook of Polar Lawの企画編集及びPLS公式ホームページ立ち上げなどを行った。また本研究成果を大学院教育に活かす取組として、2024年度後期にInternational Polar Law IIを開講し、極域国際法の体系的提示を試みた。

関連する研究成果としては、研究代表者が共同編者となるYearbook of Polar Law, Vol.15の発刊、オンライン学術誌Current Develpments in Arctic Law第12巻にConference Reportの発表、国際学会での3件の研究発表がある。

Reason

海外連携相手機関であるラップランド大学北極センターとの共催にて、日本の北極政策のレビューを行うワークショップを企画・開催し、同センターの極域国際法研究者・Ph.D院生などと交流する機会を実現でき、今後の国際共同研究の基礎を築くことができた。オーストラリアのタスマニア大学とは、別予算で招へいした同大教授のJeff McGee及びHodgson-Johnston上級講師と神戸にて今後の国際共同研究のトピック等について具体的に検討を行うことができ、今後の進展が期待できる。

Strategy for Future Research Activity

2025年度は、研究代表者がセンター長を務める極域協力研究センターがPLSの暫定事務局となっていることを活用し、本課題の目標であるPLSを国際学会に発展させるための諸活動を強化する。具体的には、PLS専用ホームページの定期的更新を、ラップランド大学所属の大学院生を謝金で雇って行う。10月グリーンランド・ヌークで開催される第18回極域法国際シンポジウムに研究代表者を派遣し、極域国際法に関する複数のセミナー、個別報告を企画し、同シンポジウムの運営及び将来の発展について、ラップランド大学Timo Koivurova教授、タスマニア大学Indi Hodgson-Johnstone上級講師などと協議を行う。

研究分担者・來田を、別予算でタスマニア大学及び南極海洋生物資源保存条約(CCAMLR)事務局に派遣し、今後の国際共同研究のためのネットワーク構築を図る。研究分担者・稲垣を、別予算で第18回PLSに派遣し、南極観光活動に関する国際共同研究の契機を創設する。研究代表者が招へい編者を務めるYearbook of Polar Law第17巻の発刊を年度内に目指す。タスマニア大学Jeff McGee教授と南極非核化に関する共著論文を作成し、年度内の発表を目指す。
