This study has examined how to prevent the possible human rights violations resulting from the imposition of UN economic sanctions in the form of smart sanctions (targeted sanctions). As a result of the study, it has become clear that the designation of targeted persons without going through any judicial processes in smart sanctions may well lead to infringement of human rights of the targeted persons, in particular their right to property and right to liberty of movement. In this connection there are certain favorable developments in the Security Council. The Council introduced a system of Ombudsperson by its Resolution 1904(2009) and strengthen it by Resolution 1989 (2011) to be a system in which the view of the Ombudsperson regarding delisting will be sustained unless the Sanctions Committee decides otherwise by consensus. This virtually means that his/her view recommending delisting will most likely be respected.
