Outline of Research at the Start

「無知」と呼ばれる状況を明確化かつ分類し、各事例において法的、倫理的にどのような責任判断がなされるかを整理し、両者の責任判断の特徴をあぶり出す。そして「無知の行為の責任」に関しては、これまで「有責な無知」に関して提出してきた研究業績における主要な論点を、「法の無知」との関連から再配置し、道徳的責任概念の法律的な有効性を探る。そしてこれらの成果を、無知状態が行為の選好に影響を及ぼしうる「適応的選好形成」や、当事者が発した言葉が差別的含意をもっていることを知らずに相手に害を与える「認識的不正義」の問題に関連付け、「無知」が及ぼす行為によって法的・道徳的責任がどのように位置づけられるのかを模索する。
