Outline of Research at the Start	現代アメリカ法実践・法哲学における積極的差別是正措置（AA）の肯定派・否定派を特徴づける対立図式は、AA正当化論の可能性を不必要に狭めるとともに、個人としての尊重原理とAAとの複雑な関係を捉え損ねている点で問題含みである。本研究は個人としての尊重原理を基底にしたAA正当化の一般理論の構築を目的とする。具体的にはまずAAの代表的な正当化論につき、個人としての尊重原理との親和性について検討する。その上で、個人としての尊重原理から望ましいAAの形態について検討し、そうした識別を可能とするような違憲審査基準について検討する。
