Outline of Research at the Start

本研究は，法律上は重い扶養義務が負う点や優先順位の高い相続権を有する点で緊密な親族kinと位置づけられる兄弟姉妹の関係に着目し，日本と英国を対象として，実際の関係性に基づく兄弟姉妹間の交流の有無や多寡などの要因が相互扶養や親の介護・相続問題への対応において及ぼす影響について調査・検討するものである．その上で，法律が規定するところの関係性と実際の関係性との齟齬から生じうる問題を抽出し，少子化による兄弟姉妹を持たない世代が増加する超高齢社会において，兄弟姉妹が親族kinとして果たすことを求められてきた役割や機能を「ほかの誰か・何か」が代行することの可能性やその仕組みづくりなどを明らかにする．
