Outline of Research at the Start

生と死という生の両端領域における法政策的制度設計にあたり、その実務的要請を理解した上で、理論的正当化／正統化の理屈を提供し、この領域で進む各種利害関係者参画型の協働型意思決定モデルの妥当性と限界及び必要な修正に向けた提言を支える理由づけの提示を行う。そのために、①現代リベラリズム法学が基盤とする〈個人の尊重〉の意義の再検討、②従前の〈専門知〉の社会的位置づけ、③新たな展開を見せる〈専門知〉の状況、これら3点を調査・検討することによって個人の尊重を基調とするリベラリズム法学と、集団的な真理探究の営みという専門性を背景とする〈専門知〉との間にある緊張と接続可能性及び限界を解明する。
