Outline of Research at the Start

本研究は、不実証広告規制の解釈・運用において実現されるべき「消費者の利益の保護」と「事業者の憲法上の自由の保障」の適切な均衡点を明らかにしようとする。前提として、①不実証広告規制の行政調査論における位置づけの把握（制度面）をしたあと、②景表法７条２項を適用して優良誤認表示該当性をみなすための要件およびその判定方法の精緻化（要件面）、③優良誤認表示該当性がみなされることの効果およびその射程の明確化（効果面）、④優良誤認表示該当性をみなして措置命令・課徴金納付命令をする際に求められる適正手続の明確化（適正手続面）へと進む。
