Outline of Research at the Start

執政の政策決定に専門家が関与する場合、その民主的政治過程が専門家の関与によって歪まないように、組織・手続に関して規律する仕組みを憲法理論から考察するとともに、この仕組みを事後的に厳格にチェックする司法審査の理論を打ち立てることが目的である。ドイツでの経験や理論的蓄積を参照しつつ、日本における制度設計の前提条件を整備する。専門知を執政に取り込む憲法論上の論拠を提示し、執政に対して助言する手続をいかに憲法適合的に設計できるか検討する。この設計を適切に保持するために、専門知を相対化して評価する仕組みと、専門家の関与により民主的政治過程が歪む場合に司法が厳格審査を行う仕組みを、憲法理論として考案する。
