Outline of Research at the Start	食料は、人がその生命・健康を維持する上で日々摂取することが欠かせないものであると同時に、社会的・文化的な営みとして精神的な健康にも大きく影響する。しかし、日本の食品分野において、安全性の確保以外の論点はかならずしも重視されておらず、食品の安全性の確保と地域の食文化の保護・継承を一体的に追求してきたEUとは異なり、文化的価値との相互関係や衝突の可能性、均衡については十分に考慮されていない。そこで本研究では、EU食品分野の取組を比較対象として、日本の法学において従来の議論では十分に検討されてこなかった食文化という「価値」の観点から、地方自治体の独自措置を基礎づけるための法理論について検討する。
