Outline of Research at the Start	1990年代中葉以降、非国際的武力紛争に適用される国際人道法上の規則は劇的に変化したと言われる。旧ユーゴスラビア国際刑事裁判所（ICTY）、さらに国際刑事裁判所（ICC）が国際的武力紛争に適用される国際人道法上の規則を非国際的武力紛争に導入（類推）するという展開を示したからである。本研究は、主に国際刑事裁判の実践を素材とすることによって、この展開を再検討することを目的とする。
