Outline of Research at the Start

本研究では，「国際的な人の移動や身分関係の形成，変動において，国際私法上「性」をいかに取り扱うべきか」との学術的問いを中心として，国境を越えた人の往来が勢いを増す一方，人の性の扱いが多様化する現代社会において，国際私法上「性」の問題をいかに扱うべきか，との問題に対する一定の答えを導くことを目的とする。より具体的には，インターセックスの人々にかかる性の問題を取り上げ，議論の先行する各国における議論や立法の状況を概観することで，日本でのあるべき対応や解釈論を検討し，もって，国際私法分野において「性」をいかに取扱うべきかにつき，現時点で一定の解答を導こうとするものである。
