Outline of Research at the Start

本研究は、海面上昇が基線やその外縁の法的地位にどのような影響を与えるのか、また沿岸国はそのような事態に対していかなる措置を講ずる義務を有するのかについて、国連海洋法条約を中心にその権利義務関係の整理と理論化を行うことを目的とする。現在、この問題をめぐっては、国連国際法委員会等において議論が継続されているが、学説上も国家実行上も、その理論的基礎が十分に説明されないまま、結論が先行する形で、通説とは異なる解釈論が展開されており、理論上の問題点を内包している。このため、近年の学説と国家実行ならびに関連する判例等を踏まえ、海面上昇が海洋法制度に与える影響を検討するものである。
