本研究は、国際裁判所等の救済方法を重大な人権侵害に着目して体系的に分析することで、国際法における司法的救済の性質と内容を明らかにするものである。本研究は、重大な人権侵害に視点を定めることにより、裁判機関と救済方法を体系的に比較実証分析する点に特徴がある。そして、本研究は、国家責任法の整序と裁判機能の把握をのみならず、国際・国内両面における訴訟実務の精緻化に資するものである。
