Outline of Research at the Start	本研究は、民法における「雇用」の意義について、日本民法典の制定過程から現代までを対象に、それぞれの時代の企業組織や働く人の就業形態の型を念頭に置きながら、歴史的に検証することを課題としている。本研究は、それを通じて、最終的には、現代における「雇用」の意義を、プラットフォーム労働者やフリーランスなどの自営的就業者の労働法的保護のあり方との関連で、理論的に検討することを目的としている。具体的には、自営的就業者を「雇用」契約の一方当事者たる「労働者」（雇用労働者）として捉えることができるのかを歴史と比較を通じて明らかにするとともに、かかる雇用労働者を対象とした労働法政策の新たな可能性を探求する。
