Outline of Research at the Start	実行行為、実行の着手、不作為犯といった古典的なテーマ、不正指令電磁的記録の罪などのコンピュータ・サイバー犯罪、名誉犯罪という古典的でありつつネットにおける現代的テーマ全体を見通す形で、「判例」と「学説」の影響関係を精密に同定することを目標とする。とりわけ大審院時代や昭和20年～40年代の判例について、当時の議論状況に立ち返ってその本来的意義を明らかにすることで、今後の議論の土台を構築することを目指す。
