Outline of Research at the Start	令和３年の少年法改正により１８歳及び１９歳の者は「特定少年」とされ、成人（２０歳以上）とも１８歳未満の少年とも異なる取り扱いを受けることとなった。特定少年は基本的には少年として保護の対象となる一方でその犯罪行為に基づく責任に基づいて（かつその責任の限度で）少年法や刑法による処分の対象となる意味において、「中間的な取り扱い」を受ける。本研究は、この「中間的な取り扱い」を受ける特定少年という存在の性質及び特定少年に対する手続の分析を踏まえた上で、特定少年に対する特例（中間的な取り扱い）を若年成人に拡大可能か否か、その具体的な制度はどのようにあるべきかを解明しようとするものである。
