Outline of Research at the Start	本研究は、「アジャイル・ガバナンス」というガバナンスモデルに示されるような現代社会における法的規制の枠組みの変容という問題状況のなかで、経済刑法として対象化される罰則規定が普遍的に抱える行為規範の不確定性という問題に対し、事業者等の主体的な取り組みを視野に入れた経済活動の自由を保障する制度的枠組みをいかにして構築すべきか、という問題意識のもと、文献研究及び調査研究を通じて、経済刑法における行為規範の具体化とその手続的保障をめぐる理論的・実務的課題を明らかにしようとするものである。
