Outline of Research at the Start	深刻化が著しいサイバー犯罪等の被害に関しては、いわゆるレピュテーション・リスクへの懸念や当該情報に個人情報や営業秘密が含まれるとの理由から、その通報や公表を躊躇する事象がしばしば見られる。従来の刑事手続法理論では、犯罪被害に関する通報等は「被害者・目撃者等の任意」であり、通報や公表を促すことは考えられていない。しかし、サイバーセキュリティに関する情報を、単独機関のみで把握することは困難となる一方、被害の拡大の防止のためには、関係情報の早期の共有・公表が不可避となる。本研究では、サイバー被害情報の法的性質の検討を手がかりに、刑事手続における情報の扱いに関する新たな理論的展開の必要性を探究する。
