Outline of Research at the Start	本研究が明らかにしようとするのは以下の2点である。まず、１点目であるが、諸外国での実態調査を踏まえ、それぞれの国での、憲法その他の人権関連法規との整合的な運用方法を解明する。このことにより、我が国の憲法等との関係で許容される、新規定の実施方法や対象者の位置情報の保存・利活用の問題を解明する。そして、２点目であるが、以上のような憲法その他の人権関連法規と矛盾しない実施方法が、保釈法制として、どれだけ罪証隠滅・逃亡の防止に資するのか、また、未決拘禁の回避となるのかという実証的な解明を行う。そのうえで、GPS型電子監視が、国外逃亡防止目的以外で有効かつ適切な領域を提案する。本研究の概要は以上である。
