Outline of Research at the Start	本研究は、未成年者がなお発展途上の存在であり、自己決定能力も常にないわけではないが劣っているところがあることを考慮し、未成年者の利益に最もつながる「被害者の同意」の有効要件について、詳細に検討していこうとするものである。その際には、かつての研究で示唆を得た「未成年者の健全育成（又は福祉）」という視点を重視し、その人生に係る物事について未成年者に「共同決定」の権利を授け、あるいは未成年者の浅慮から未成年者を守る解釈論を提供しようとするものである。
