Outline of Research at the Start	①SNS上のヘイトスピーチをヘイトクライムの導因と理解し、②EUのデジタル・サービス法の施行を目前にして、EUやドイツ等のSNS規制の意義と削除やブロッキングに内包する法的問題を検証し、③ヘイトクライムに対する刑事司法実務並び立法について諸外国との比較研究を通じて、④差別動機や偏見・憎悪感情に基づく行動に対して、民間資源の活用による非規制的対応や修復的司法の手法を取り入れつつ、他方で、⑤SNS上のヘイトスピーチの規制の必要性、⑥量刑段階での差別動機の取り扱い、⑦特別法の制定や量刑規定の導入等、刑事規制の可能性とその手法を構想する。
