Outline of Research at the Start

本研究は、倒産管財人(破産法上の破産管財人及び民事再生法・会社更生法上の管財人)という倒産手続の中心たる機関の責任について、理論的かつ包括的な検討を行い、倒産手続の特性を踏まえた理論を定立し、手続の円滑な遂行に向けた職務規律のあり方を提示することを目的とする。具体的には、倒産管財人の義務違反に基づく責任に関し、我が国実定倒産法制度の沿革に遡るとともに、米独法などの比較法的分析、更には民商法その他の隣接法分野との比較を行いつつ、理論と実務を網羅的に検討する。本研究により、管財人に関する行為規範の定立、そして義務違反の責任追及に向けた評価規範の形成に資するものと考える。
