Outline of Research at the Start

法は、人々がより良く共同生活を送るために進化してきたシステムである。しかし、望ましいシステムを構築するためには、社会に分散している膨大な情報を適切に処理するというコストがかかる。そこで、法は情報処理をより効率的に行うために様々なサブシステムを備えている。本研究は、民法という法律をそのような情報処理システムという観点から理解し直し、民法の中に含まれているさまざまな制度にはどのような意義があるのか、民法の解釈論（場合によっては立法論）としてどのような新たな提案をなしうるか、といった問題について考察を行うものである。
