Outline of Research at the Start

本研究の目的は、①投資勧誘について「市場による規律」が機能するための条件は何か（わが国においてどの程度備わっているか）、②投資勧誘規制に係る様々な制度・法理の長所・短所は何かを分析し、これらを前提に、③市場による規律や各種投資勧誘規制の役割分担・エンフォースメントのあり方はどうあるべきかを考察することである。研究方法としては、アメリカの投資勧誘規制を参照する比較法的考察に加え、経済学・行動経済学の議論や他の法分野の議論を参照することで学際的・法領域横断的観点から総合的な研究を行う。
