Outline of Research at the Start	本研究は、消費者契約法制が直面している限界と制約を乗り越えるための方策として、(1)行為規制の導入とその「柔軟」化という観点から、ソフトローとして位置づけられる努力義務の基礎にある原理ないしスタンダードを「指針」として提示し、そのエンフォースメントをはかるための方策を提示し、(2)民事規制の「柔軟」化という観点から、契約の拘束力からの全部又は一部の解放を実質的に可能にする新たな救済手段を検討する。
