Outline of Research at the Start

内外人平等の観点から、英米のリミテッド・バートナーシップという外国の非法人型団体の当事者能力等に関する裁判例における肯定的結論を梃子にして、内国における組合型団体の訴訟上の地位をめぐる議論の見直しを図ること、そして、世界的な広がりを見せる投資ファンドとその権利保護という観点から、外国の非法人型団体の地位を渉猟し、それらが日本の裁判制度を通じた権利保護を求める場合、民事訴訟法２９条を適用する前提問題としての外国団体の地位がどのようなものか、それが同条の適用の際にどのような影響をもつか、日本の訴訟手続における地位がどうなるかを、目的論的見地から検討する。
