Outline of Research at the Start

本研究は、倒産と仲裁が交錯する問題について、日本法と仲裁が盛んに利用されている香港、中国大陸、シンガポール等アジア地域の制度や国際準則との比較考察を通じて、集団的な債権債務整理手続である倒産手続と紛争解決手段の選択における当事者意思の尊重の表れである仲裁手続の調和や制度間の連携を図る法理について探求することを目的とする。具体的に、①倒産手続における仲裁合意の拘束力、②係属中の国内外仲裁手続と倒産手続、③債権者による倒産手続開始の申立てと仲裁合意の効力、④私的整理・倒産ADRにおける仲裁機関の仲介役等の問題について掘り下げて考察する。
