Outline of Research at the Start	本研究は、裁判、仲裁、調停、裁判上の和解を含む国際的な民事紛争処理制度全体の実効性の向上を目指すものである。国際的な紛争の多くが仲裁、調停等のいわゆるADRにより処理されていることは周知の事実ではあるが、その実効性は、裁判の実効性に依存する。そこで、本研究では、国際的な紛争に係る裁判の実効性を高めるべく、多国間条約の可能性および国境を越えたITの利用の可能性を検討する。その上で、いわゆるADRに関しては、とりわけ裁判上の和解と仲裁、調停の間の役割分担に留意しつつ、全体としての実効性を高めるべく、多国間条約締結の可能性や国内法の改善の余地を検討する。
