Outline of Research at the Start	本研究は子の利益のための親権行使の在り方について検討を行うものであり、いわゆる離婚後の共同親権をめぐる論点として①離婚後の父母双方を親権者と定めた場合に父母間の対立が生じた際の共同親権行使の方法、②養育費請求権の法的性質及び行使方法について理論的研究を行うものである。また本研究ではドイツ民法との比較研究を行う。①についてはBGB1628条に家裁の介入を認める定めがあり裁判例も含め分析を行う。②については養育費請求権の法的性質及び行使方法についてもBGB1629条2項2文の規定があり、親権者が代理行使する構成を再検討する上で参考にする。2023年8月25日「扶養法改正の基本的原則」も検討する。
