Outline of Research at the Start	本研究では、違法収益剥奪をめぐる日本法の従来のあり方を文献調査に基づいて整理・検討し、その限界とされてきたものを明確化したうえで、近時これについての議論が盛んに行われているフランス法を参照し、これを整理・分析することによって、ありうる対応策を模索する。その際、フランス法文献の調査のみならず、フランス人研究者との議論によって近時の議論状況を把握し、問題状況の法的・社会的把握に努める。
