Outline of Research at the Start

本研究は、これまで申請者が国内研究協力者および海外の研究協力者の協力を得て行ってきた比較法研究の成果を生かしつつ、「改正区分所有法（案）」の各制度（前記の①～④を含む１０～１５項目）を評価し、今後のマンションを中心とした区分所有法制の課題を提示する点において、学術的な独自性と創造性があると思われる。日本において、これまでこのような区分所有法制に関する網羅的・総合的な研究は皆無であり、本研究は、民事法学における比較的新しい領域である「マンション・区分所有法制」の先端的な研究であると考える。また、本研究は、建替え制度を有する韓国や中国の今後の法制度にとっても意義を有するものであると思われる。
