Outline of Research at the Start

日本において倒産前（pre-insolvency）からアプローチが可能な「法的企業再建スキーム」の構築に向けて、その目指すべき方向性を明らかにするために、日本やイギリスの制度を探求・分析し、その成果をとりまとめる予定である。
具体的には、①日本の議論状況・立法動向を整理し、②日本・イギリス（英法系の国を含む）の関連法令・判例・学説等の資料を収集した上で、③イギリスにおいて倒産法研究者・事務弁護士（Solicitor）・倒産実務家（IP）を中心にインタビュー調査等を実施する。
これらを踏まえて、④日本において適正に機能する「法的企業再建スキーム」を検討し、その検討の成果を学会や紀要等で公表する。
