Outline of Research at the Start

本研究は、①医療に内在するリスクと②患者のニーズの多様性を医療の特性と仮定し、それに基礎づけられ、導かれる医師と患者の法的関係の原理的な根拠と発展の方向性をあきらかにしようとするものである。
そのために、法の形成や発展の過程において共通する他の法領域（消費者法、環境法）との比較を通じた相対化という手法を採用する。
本研究では、次の【１】～【３】の小テーマを、順次に、かつ相互に関連づけながら検討してゆく。【１】医療に内在するリスクに対する解釈論・法制の検討、【２】患者のニーズの多様化に応えた法の進展の検討、【３】リスクの再分配──本来的な独自性【１】と新たな発展の方向性【２】の関係の究明
