Outline of Research at the Start	天然資源の管理に関する議論で、米国のコモン・ロー上の公共信託理論（PTD）がしばしば取り上げられる。天然資源である空気、樹木、水等は、国民（住民）の共通の財産であるため、国家（州）はこれらの管理を国民からその管理を信託されているという趣旨である。本研究は、①PTDの法的性質（各州での歴史的淵源、州のコモン・ロー上の解釈、公衆の権利）を明らかにし、②PTDの現代的な意義であるレクリエーションの権利への適用内容の正確な把握に努める。その上で、③米国内、日本国内、および国際社会における拡大適用説と拡大適用慎重説との議論を調査・整理し、日本や国際社会への示唆を検討するものである。
