Outline of Research at the Start

著名商標に代表される著名な名称の保護のあり方については、これまで、識別力と保護範囲の関係が分析対象とされ、これにより、保護すべき範囲の限界を特定するという議論がなされてきた。これに対して、著名な名称のうち、地域団体商標や地理的表示は、保護に至るまでに長期間を有することから、名称利用（関係）者が特定地域の複数の者に及び、需要者に対する名称のブランド管理が容易でない、もしくは直接的管理が困難であり間接的な管理に期待するほかない等の一般的な著名商標とは異なる性質を有している。本研究では、準公共財的要素が名称保護に与える影響を分析し、これらを含む著名な名称の保護のあり方を明らかにする。
